Summary of Terms
Potentiallist (Pty) Ltd (“Potentiallist”) is an exclusive, private membership club. Our services offered are by invite only, however, we welcome you to contact us to be considered. When you engage with Potentiallist, you agree that you have read and agreed to our Terms of Use. These terms form an agreement between you and Potentiallist. We have provided a short summary of our terms as set out below.
Acceptance. 
By using the service, and submitting an application to us, you agree to this agreement, our Privacy Policy and any terms that apply to any services we may offer.
Eligibility. 
You must be at least 22 years of age when engaging our services and submitting an application for membership. We reserve the right to refuse membership or reject any applications at our sole discretion, without providing reason(s).
Termination. 
We may modify our service offerings at any time or discontinue them altogether. You can contact us to withdraw your application at any time, or to request that we delete or modify any information you have provided. We reserve the right to terminate any of our services, at any time and for any reason, within our sole discretion. We may also terminate our services if you violate this agreement, our Privacy Policy or any of our terms.
Disclaimers. 
Our Service is provided “as is”, and we disclaim all legal liability that may arise.
Limitation of Liability.
To the extent allowed by law, we limit our liability to you for certain types of damages for claims relating to your use of our services, the conduct of other members and any unauthorized access or use of your content. You agree that our aggregate liability to you for any claims, howsoever arising will not exceed the total fees you pay us. If no fees have been paid by you, our liability will be limited to a maximum amount, not exceeding ZAR1000.00 (one thousand Rands only).
Dispute Resolution. 
Our Terms of Use contain a mandatory dispute resolution clause. You agree that any disputes will be settled through this mechanism.
Governing Law.
South African law applies to this agreement. Actions for disputes relating to this agreement must be brought in a court in South Africa, having appropriate jurisdiction to hear the matter.
Indemnity. 
You agree to indemnify us for actions arising out of your use of the service, your content or your violation of this agreement, our Privacy Policy and Terms of Use.
